
Procedure for Familiarization with Arbitration Case Materials
In order to improve conditions for the exercise of the right of interested parties to familiarize themselves with the materials of arbitration cases, the ISAC Arbitration introduces the following procedure for familiarization with the materials of arbitration cases under its jurisdiction.
The right to access an arbitration case arises from the moment an order is issued to accept a statement of claim for processing by the ISAC Arbitration (hereinafter referred to as the Arbitration).
Access to the materials of arbitration cases is granted based on a written request from the party seeking to review the case.
Access is granted with the permission of the arbitrator handling the case, the substitute arbitrator, or in their absence, the Chairman of the Arbitration.
Requests for familiarization with arbitration case materials can be submitted to the Arbitration's secretariat.
The request for familiarization with the case materials must be signed by the applicant or another authorized representative, with a document confirming the authority to access the case.
The party requesting access to the case will be provided with the case file by the Arbitration secretariat for review on the 4th (fourth) working day after the request is received by the Arbitration.
In cases where the request is submitted electronically, the date of receipt of the request is considered the date the Arbitration sends an acknowledgment of receipt of the request.
On the day the request for familiarization with the case materials is received, the secretariat staff registers the request under the case number as a request for case review and subsequently forwards it to the arbitrator handling the case (if the case is archived, the matter of review is transferred to the Chairman of the Arbitration).
